CONTRACTS

Acceptance from Cross Healthcare Ltd., of Bandeath Ind Est., Throsk, FK7 7NP (hereinafter called "the Company") of any order placed by the customer (hereinafter called "the Customer), shall constitute a contract between the Company and the Customer upon and subject to the following Terms and Conditions to the exclusion to the extent permitted by the law of all other warranties and conditions expressed or implied by law or otherwise. The Company shall be deemed to have accepted and order upon delivery of goods in performance of the order, The Company shall be deemed to have accepted the Terms and Conditions of the Company by placing an order.

PRICES

Prices and delivery terms are without engagement and may be subject of variations without notice. Prices rule as the date of delivery notwithstanding any quotation preciously given. All goods are subject to Value Added Tax at the prevailing rate.

PAYMENT TERMS

Payment is paid immediately once goods have been ordered. The account will be deemed to be overdue in the event of non-payment by the date due. In the case of non-payment of the statement by the due date, orders will not be assembled without further notice.

The Company reserves the right to charge the Customer interest at the rate of 2.0% per month for every month on the amount, which remains overdue.

TITLE TO GOODS

No property in any order of the goods delivered hereunder shall pass to the Customer until the company has been paid in full.

The Company shall be entitled to retake possession of unpaid goods if The Customer has failed to pay for the same in accordance with the contract The Customer shall become insolvent or bunkrupt.

The Company shall be entitle to maintain a statement upon any of the goods stating that the Company is the owner until properly has passed to the Customer under these conditions of sale.

RETURN OF GOODS

Conditions for the return of goods which are the subject of complaints as follows:

Any returned stock must be suitable re-packaged in order that the goods arrive back with us in the same conditions as supplied.

Goods must be returned within 7 days of receipt.

Any shortage must be reported on the same day that the delivery is made.

A credit note will not be issued unless the criteria are met.

GUARANTEE AND LIABILITY

Goods supplied by the Company are guaranteed in accordance with the terms of the manufacturers warranty provided with the goods.

The Company accepts no liability whatever nature arising as a result of any representations, breach of contract, negligence or otherwise. Including, but not limited to, any liability for indirect or consequential loss or loss of profits, revenue, business or goodwill except for liability for death or personal injury caused by the Company's negligence.

All conditions, warranties and representations, expressed or implied by statute common law or otherwise in relation to the goods (other then any liability which the Company is not permitted by law to restrict or exclude) are hereby excluded.
